S. 134 OF THE INDIAN TRADEMARKS ACT RELATES TO THE INFRINGEMENT PROCEEDINGS IN INDIA:
Section 134 of the (Indian) Trademarks Act, 1999 . Suit for infringement, etc., to be instituted before district Court.- (1) No suit -
(a) for the infringement of a registered trade mark, or
(b) relating to any right in a registered trade mark, or
(c) for passing off arising out of the use by the defendant of any trade mark which is identical with or deceptively similar to the plaintiff trade mark, whether registered or unregistered, shall be instituted in any court inferior to a District Court having jurisdiction to try the suit.
(2) For the purpose of clauses (a) and (b) of sub-section (1), a "District Court having jurisdiction" shall, notwithstanding anything contained in the Code of Civil Procedure, 1908 (5 of 1908) or any other law for the time being in force, include a District Court within the local limits of whose jurisdiction, at the time of the institution of the suit or other proceeding, the person instituting the suit or proceeding, or where there are more than one such person any of them, actually and voluntarily resides or carries on business or personally works for gain.

Design registration:
Any article can be made to designed under the Designs Act 2000.The Designs Act 2000 intends to protect the shape configuration pattern ornament or composition of lines and colors so as to save the aesthetic and the artistic value attached with the article which has been manufactured either by chemical, mechanical or manual means. A controller of designs office has been constituted by the Government of India where the designs applications can be file. The design can be sought for the design of jewellery, Gem stones, bottles, or any other article which as some aesthetic value attached to it and it eventually becomes a part of intellectual property of that person. The design shall be novel, should not have been published before and should have artistic value attached to it. The application can be file in the New Delhi Registry Office. The design after getting nod from the controller of Designs is entered in to the register of designs.
